Effective from: March 29, 2025
1. Introductory Provisions
1.1 These Terms and Conditions (hereinafter referred to as the "T&C") govern the rights and obligations between the operator of the online store on the website cultie.sk (hereinafter referred to as the "Website") and the buyer (hereinafter referred to as the "Buyer") when purchasing goods via the Shopify platform.
1.2 The seller is:

1.3 The Buyer is a natural or legal person who enters into a purchase agreement with the Seller through the Website.
1.4 These T&C are an integral part of the purchase agreement. Different agreements take precedence over the T&C if confirmed in writing by both parties.
1.5 The online store is operated via the Shopify platform, whose terms of use (available at shopify.com) apply to the technical operation of the store.
2. Orders and Conclusion of the Purchase Agreement
2.1 Goods (bowls, hoodies, t-shirts, bags) can be ordered exclusively via the Website by filling out the order form on the Shopify platform.
2.2 An order constitutes a proposal by the Buyer to conclude a purchase agreement. The purchase agreement is concluded at the moment the Seller confirms receipt of the order via e-mail to the address provided by the Buyer.
2.3 The Seller reserves the right to reject an order if the goods are unavailable, if the Buyer has failed to meet obligations from previous agreements, or if the identity of the Buyer cannot be verified.
2.4 Prices of goods are listed on the Website in euros (€), including VAT unless otherwise stated. The Seller reserves the right to change prices, but the price stated in the order confirmation is binding for the Buyer.
3. Payment Terms
3.1 Payment for goods can be made using the methods offered by the Shopify platform, including:

3.2 Payment must be received by the Seller before the goods are shipped, unless cash on delivery is chosen (if available).
3.3 The goods remain the property of the Seller until the full purchase price is paid.
3.4 The invoice is sent electronically to the Buyer's e-mail and serves as a tax document.
4. Delivery Terms
4.1 Goods are delivered within the territory of the Slovak Republic, or abroad if enabled in the store settings on Shopify.
4.2 The usual delivery time is 5–10 business days from the confirmation of the order, unless otherwise stated. The Seller is not liable for delays caused by the carrier or force majeure.
4.3 Delivery methods and their costs are listed at checkout on the Website. The Buyer selects their preferred delivery method (e.g., Slovak Post, courier).
4.4 The Buyer must check the goods upon receipt and notify the Seller of any visible defects within 24 hours of delivery via e-mail at cultie@cultie.net.
5. Withdrawal from the Agreement (Returns)
5.1 The Buyer has the right to withdraw from the purchase agreement without giving any reason within 14 days of receiving the goods in accordance with Act No. 102/2014 Coll. on Consumer Protection in Distance Selling.
5.2 Withdrawal must be announced in writing via e-mail [e-mail] or using the withdrawal form available on the Website.
5.3 The goods must be returned to the Seller's address ([address]) within 14 days of the withdrawal notice, unused, undamaged, in the original packaging, along with proof of purchase.
5.4 The Seller will refund the amount paid by the Buyer (including the cost of the cheapest delivery method) within 14 days of receiving the returned goods, to the account provided by the Buyer.
5.5 The cost of returning the goods is borne by the Buyer unless the goods are defective or delivered in error.
6. Complaints and Warranty
6.1 Goods are subject to a 24-month warranty period from the date of receipt unless stated otherwise.
6.2 Complaints can be made via e-mail to cultie@cultie.net, including a description of the defect and attached photos. The goods must be sent to the Seller’s address along with proof of purchase.
6.3 The Seller will process the complaint within 30 days of receiving the claimed goods.
6.4 If the complaint is justified, the Seller will ensure repair, replacement of the goods, or refund.
7. Personal Data Protection
7.1 The Buyer’s personal data is processed in accordance with EU Regulation 2016/679 (GDPR) and Act No. 18/2018 Coll. on Personal Data Protection.
7.2 The Seller processes the data necessary for order processing (name, address, e-mail, phone number) and retains it for the time necessary to fulfill the contract and legal obligations.
7.3 Details about data processing are provided in the Privacy Policy on the Website.
8. Cultie Club Membership
8.1 Purchasing from the online store is not conditioned by Cultie Club membership.
8.2 Membership in the Cultie Club is by invitation and governed by separate rules not included in these T&C.
9. Final Provisions
9.1 The Seller reserves the right to amend these T&C. The new version will be published on the Website and is effective from the date indicated in the header.
9.2 Matters not covered by these T&C are governed by the Civil Code, the Consumer Protection Act, and other laws of the Slovak Republic.
9.3 Any disputes will be resolved out of court, or before the competent court in the Slovak Republic. The Buyer has the right to contact the Slovak Trade Inspection (www.soi.sk).
